Why in news?????
Great allegation of corruption against senior functionaries of CBI government stepped October 24/2018 appointed M.Nageswar Rao as interim CBI director with immediate effect.
    As India's premier investigating agency ... the Central Bureau of Investigation of the CBI handles all high-profile cases....Its job is to ensure a fair and an impartial probe. But in recent days, the agency has been in the news for all the wrong reasons. Two of the top officials of the agency - director Alok Verma and Special Director Rakesh Asthana are involved in a major feud... that has forced the government to intervene. Both officers have been have been sent on leave ... with the government claiming that the decision was taken to restore the institutional integrity and credibility of CBI...
     Finance miniter arun jaitely said the government decision to remove Alok Verma & Rakesh Asthana was based on the recommendation of the Chief Vigilance Commission asserting that it was essential to restore the CBI ‘s institutional integrity & credibility.
Alok Verma Vs Rakesh Asthana
  • Spat 1st of its kind in CBI’s history.
  • It became public when Verma objected to the elevation to Rakesh Asthana (additional director of CBI) before CBI.
  • Although objections were noted the commission in a unanimous decision cleared Asthana’s promotion as special director making him second income of agency.
  • A PIL by NGO common cause rejected by Suprem Court.
  • Rakesh Asthana filed complaint against Alok Verma on24/ august./2018
  • Asthana alleged Verma took a bribe of  Rs.2Crore  from an accused investigated by him.
  • Asthana also complained there are about 10 more cases of alleged corruption  & irregularities against Verma.
  • Matter was reffered by Central Government to CVC which soughts files of cases mentioned in Asthana’s complaint.
  •  Alok Verma told CVC that asthana’s role was under probe in at least six cases .
  •  Asthana urged Government to intervene, sought independent probe into allegations levelled by Verma.

ESCALATING FEUD

  •    Oct 15: CBI registers  FIR against Rakesh  Asthana for allegedly taking a bribe from an accused in lieu of ensuring relief.
  • Case was registered on a statement of alleged bribe giver, Satish Sana
  •  Sana facing probe in separate case of bribery involving meat exporter Moin Qureshi
  • CBI arrested Devender Kumar, a Deputy SP in Rakesh Asthana’s team.
  • Asthana’s complaint against Alok Verma two months ago alleged that Sathish Sana paid Alok Verma Rs. 2 crore to get relief. Rakesh Asthana approaches Delhi High Court.
  • Delhi HC directed CBI to maintain status quo on criminal proceedings initiated against Asthana till October 29.
  • Appointment of CBI director
  • Till 2014,appointments were made as per Delhi Special Police Establishment Act,1946.
  •  DSPE act revised in 2003 on Supreme Court’s recommendation. 
  • Under DSPE  act Central Government formed in Committee headed by the CVC.
  • Committee had members from CVC, Secretaries from Home Ministry, Ministry of Personnel & Public Grievances.
  • Committee would then send recommendations to Centre which would then appoint CBI director.

Lokpal act ,2014
  • The lokpal act ,2014 provides for a committee for appointment.
  • Committee is headed by PM.
  •  Leader of Opposition is a member of the Committee.
  • Committee has Chief Justice of India(CIJ) or a Supreme Court judge recommended by Chief Justice as member. 

Shortlisting candidates
  • Home Ministry sends list of candidates to Department of Personnel Training
  • Department of Personnel Training prepares final list on the basis of Seniority,Integrity & Experience in the investigation of Anti-Corruption cases.
  •  Final list goes to the committee headed by PM.

CBI’s Function: CBI investigates cases relating to Centre /multiple States.
  •  Investigating cases against Central Government employees or concerning affairs of Central Government.
  •  Cases in which Financial interest of Central Government are involved.
  • Cases relating to breaches of Central laws.
  • Big cases of fraud, cheating , emblezzlement.
  • Cases committed by organised gangs or professional criminals having ramifications in several states.
  • Cases having inter-state & international ramifications
  • CBI exempted from RTI Act

CBI’s Journey
  • Special Police Establishment (SPE) set up in 1941
  • Investigated Bribery ,Corruption cases of India during World War II
  •   1946: DSPE Act comes into force.
  • Home ministry took charge of SPE Act to cover all department of the Government .
  • Jurisdiction extended to all Union Territories
  • Jurisdiction to all states possible after consent from State Government.
  •  Rechristened CBI in 1963.
  • Investigating corruption cases by Central Government employees ,Employees of Public Sector & Public Sector Banks.

Established in 1902 by the British Government.
 State Government hands over cases to CID.
 High Court can also assign cases to CID.
Investigation ,Intelligence Department of State Police looks at causes of murder, assault, riots or any offence committed within the state.
